Alimony is the common name for spousal maintenance. The maintenance statute had a major revision which took effect on January 1, 2014 and now includes a formula for calculating maintenance which in it’s simplest form results in taking 40% of the higher income person’s income and subtracting 50% of the lower person’s income with a result being paid for approximately one-half of the length of the marriage.

However, this is a very complex statute and there are many exceptions to the basic rule.

Each case needs to be evaluated in light of the whole statute, and not just the rule that I stated.
